Terms & conditions.
The terms on which we provide memberships, classes and access to the studio. Please read them alongside our cancellation policy and privacy policy.
These terms are not finished. The structure below is in place but the wording is still being written and has not been legally reviewed. It is not yet capable of forming a contract.
Who we are and how to contact us
Identify the legal entity behind Nova Core Wellness — sole trader or limited company, with the company number and registered address if there is one — and how to reach us. The trading address is confirmed and given below; the entity wording still needs checking against the privacy policy.
What the system actually does
- Trading address: 193 Picton Road, Liverpool, L15 4LG.
- Trades as a sole trader owned by Natalie Melia (as stated on the privacy policy).
- Contact address used across the site: info@novacorewellness.co.uk.
Membership tiers, credits and what each includes
Set out the tiers, what each one entitles a member to each month, and how class credits work — including that they are scoped to a calendar month and do not carry over.
What the system actually does
- Tiers, prices and weekly allowances are database rows an admin can edit, not fixed in code.
- A month's credit pool is the tier's weekly allowance multiplied by the number of Monday–Sunday weeks the calendar month touches (between 4 and 6).
- Members who join mid-month get a pro-rata grant based only on the weeks remaining from their start date.
- Credits are scoped to a calendar month and are not carried over — an unused balance simply stops counting once the month ends.
- The unlimited tier is granted no credits at all; its bookings are free and never draw down a balance.
- A member who has used their credits can still book, at £8 per class, paid at checkout before the booking is made.
- Someone without an active membership books pay-as-you-go at £10 per class, also paid before the booking is made.
Payment, billing date and recurring subscription terms
Explain that memberships are recurring monthly subscriptions taken by card through Stripe, when they are billed, that the first month is pro-rated, and what happens if a payment fails. State clearly that the subscription renews automatically until cancelled.
What the system actually does
- Every membership renews on the 1st of the month — the billing anchor day is 1 for everyone.
- A scheduled job runs at 06:00 on the 1st of each month and grants the new month's credits to every active subscription.
- Card payments and subscriptions are handled by Stripe; the studio never stores card numbers.
- A subscription can be INCOMPLETE, ACTIVE, PAST_DUE or CANCELLED. Only ACTIVE draws credits — a lapsed member is treated as pay-as-you-go at £10.
Cancelling a class — the 12-hour rule
State the 12-hour rule and its consequence for the member's credit. Keep the numbers identical to the cancellation policy — this clause and that page must not disagree.
What the system actually does
- A booking is cancellable up to the moment the class starts; the 12-hour test decides only whether the credit comes back.
- The window is measured from the moment of cancellation to the class start time, and is inclusive: exactly 12 hours ahead still returns the credit.
- Cancel 12 hours or more ahead and the credit is returned to the member's balance.
- Cancel inside 12 hours and the credit is treated as used — the class is still cancelled and the place freed, but nothing is returned.

Cancelling or pausing a membership
Set out how a member cancels or pauses, how much notice is required, when access ends, and whether any part-month is refunded. Decide the notice period first — it is a business decision, not something the code currently enforces.
What the system actually does
- Nothing in the code enforces a notice period or supports pausing a membership; a subscription simply has a cancelledAt date and moves to CANCELLED.
- Credits already granted for the current month remain in that month's balance — there is no clawback on cancellation.
- Whatever notice period is chosen must be applied by hand in Stripe and in the admin dashboard until it is built.
Your 14-day right to cancel, and immediate access
Cover the statutory 14-day cooling-off right for distance contracts under the Consumer Contracts Regulations 2013, and how it interacts with starting to use the membership straight away: a member who asks for the service to begin within the 14 days can still cancel, but may be charged a proportionate amount for what they have used. This clause needs proper legal review — getting it wrong is a consumer-law problem, not a copy problem.
What the system actually does
- There is no cooling-off handling in the code at all: no 14-day window, no proportionate refund calculation, and no cancellation request flow.
- Any cooling-off cancellation has to be honoured manually in Stripe today.
Health, safety and disclosing conditions
Explain the member's responsibility to complete the health questionnaire honestly, to keep it up to date if things change, and to tell an instructor about injuries, pregnancy or medical conditions before class. Note that the studio may decline to teach someone until a GP clearance is provided.
What the system actually does
- New members complete a PAR-Q style health questionnaire and type a signature before they can book; the booking area is gated until it and the joining form are done.
- Answers are stored with a flag marking whether any response needs review, and are visible to studio staff.
- The questionnaire is completed once at onboarding — nothing currently prompts a member to review or re-confirm it later.
Studio rules and our right to refuse or remove access
Set out the expectations in the studio — arrival time, footwear, equipment, phones, behaviour towards other members and staff — and the circumstances in which the studio may refuse entry, cancel a booking or end a membership. Include what happens to fees if access is withdrawn.
What the system actually does
- An admin can cancel a member's booking on their behalf; the booking records who cancelled it.
- There is no suspension or ban state on an account — withdrawing access today means cancelling the subscription manually.
Liability
Set out what the studio is and is not responsible for, including personal injury, property left on the premises, and class or studio closures. This clause must not attempt to exclude liability for death or personal injury caused by negligence, which cannot lawfully be excluded. Have it reviewed, and check it against the studio's public liability insurance.
Changes to these terms
Explain how and when the terms may change, how members will be told, and what happens if someone does not accept the new version.
What the system actually does
- Acceptance is recorded per user, with a timestamp and the version string accepted (currently "2026-08-13").
- Bumping TERMS_VERSION in lib/legal.ts makes every existing acceptance stale, which is what a re-acceptance prompt would key off.
- No re-acceptance flow exists yet — members are not currently asked to agree again when the terms change.
Governing law
State that these terms are governed by the law of England and Wales and that the courts of England and Wales have jurisdiction.
